1. Acceptance of Terms
These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Ingesto ("we", "us", "our", "Ingesto") governing your use of the Ingesto browser extension (the "Extension", "Service").
By downloading, installing, accessing, or using the Extension, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not install or use the Extension.
If you are using the Extension on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and the terms "you" and "your" will refer to that organization.
2. Description of Service
Ingesto is a browser extension that allows users to capture, save, and organize text highlights and notes from web pages. The Extension operates locally on your device and stores all data in your browser's local storage (IndexedDB). The Service includes:
- Text selection and capture functionality
- Local storage and organization of captured content
- Full-text search capabilities
- Automatic tagging and source tracking
- Data export and import features
- Keyboard shortcuts and context menu integration
The Extension is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. Eligibility and Age Requirements
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Extension. If you are under 16, you may only use the Extension with the consent and supervision of a parent or guardian.
By using the Extension, you represent and warrant that:
- You are of legal age to form a binding contract in your jurisdiction
- You have the legal capacity to enter into this Agreement
- Your use of the Extension will not violate any applicable law or regulation
- All information you provide (if any) is accurate and truthful
4. User Responsibilities and Acceptable Use
You are solely responsible for your use of the Extension and all content you capture. You agree to:
- Maintain device security: Keep your device and browser secure, including using strong passwords and keeping software updated
- Protect your data: Regularly back up your data using the export feature, as you are responsible for data loss
- Comply with laws: Use the Extension in compliance with all applicable local, national, and international laws and regulations
- Respect intellectual property: Respect copyright, trademark, and other intellectual property rights when capturing content from websites
- Respect website terms: Comply with the terms of service of websites from which you capture content
- No illegal use: Not use the Extension for any illegal, harmful, or unauthorized purpose
- No reverse engineering: Not attempt to reverse engineer, decompile, or disassemble the Extension (except as permitted by applicable law)
- No interference: Not interfere with or disrupt the Extension's functionality or attempt to gain unauthorized access to any part of the Extension
You acknowledge that you are solely responsible for all activities that occur under your browser profile and device, and we are not liable for any unauthorized use of your device or browser.
5. Privacy and Data Storage
Your privacy is important to us. Ingesto stores all data locally on your device. We do not collect, transmit, or store your notes on external servers. For detailed information about how we handle your data, please review our Privacy Policy.
You acknowledge and agree that:
- Data loss risk: You are solely responsible for backing up your data regularly using the export feature
- Browser data clearing: Clearing your browser's IndexedDB or local storage will result in permanent loss of your notes
- Device security: You are responsible for maintaining the security of your device and preventing unauthorized access to your data
- No cloud backup: We do not provide cloud backup services, and you should not rely on the Extension as your sole method of data storage
- Website compliance: You must ensure that capturing content from websites complies with those websites' terms of service and applicable copyright laws
6. Intellectual Property Rights
6.1. Extension Intellectual Property
The Extension, including its source code, design, user interface, functionality, documentation, and all related materials, is the exclusive property of Ingesto and is protected by copyright, trademark, and other intellectual property laws. The Extension is licensed, not sold, to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension for your personal or internal business purposes.
6.2. User Content and Captured Material
Content you capture using the Extension (including text, notes, and annotations) remains subject to the intellectual property rights of the original content creators. You acknowledge that:
- Capturing content does not transfer ownership of that content to you
- You must respect copyright, trademark, and other intellectual property rights
- You are solely responsible for ensuring your use of captured content complies with applicable laws
- We are not responsible for any copyright infringement or other intellectual property violations resulting from your use of the Extension
6.3. Open Source Components
The Extension may include open source software components. Such components are subject to their respective open source licenses, which may differ from these Terms. You agree to comply with all applicable open source licenses.
7. Disclaimers and Warranties
THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR COMPLETENESS
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that the Extension will meet your requirements, operate without interruption, be error-free, or be secure. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INGESTO, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Data loss: Any loss of data, including notes, tags, or settings, due to browser updates, clearing browser data, device issues, or Extension malfunctions
- Indirect damages: Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits: Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Third-party content: Any issues arising from content captured from third-party websites, including copyright infringement, defamation, or other legal claims
- Compatibility issues: Compatibility problems with specific websites, browser versions, or operating systems
- Security breaches: Unauthorized access to your device or data, even if such access occurs through the Extension
Our total liability to you for all claims arising from or related to the Extension shall not exceed the amount you paid for the Extension (which is currently zero, as the Extension is free) or €100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Ingesto, its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of the Extension
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Content you capture using the Extension
- Your violation of any applicable law or regulation
10. Modifications to Terms and Service
We reserve the right to modify these Terms at any time. If we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Post a notice in the Extension (for significant changes)
- Provide reasonable advance notice when possible
Your continued use of the Extension after changes to these Terms constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Extension and uninstall it.
We also reserve the right to modify, suspend, or discontinue the Extension or any part thereof at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Extension.
11. Termination
Termination by You: You may stop using the Extension at any time by uninstalling it from your browser. Uninstalling the Extension will remove all locally stored data.
Termination by Us: We reserve the right to suspend or terminate your access to the Extension at any time, with or without cause or notice, for any reason, including if you breach these Terms.
Effect of Termination: Upon termination:
- Your right to use the Extension will immediately cease
- All locally stored data may be deleted (depending on browser behavior)
- You should export your data before uninstalling if you wish to preserve it
- Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, and indemnification
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the Member State in which you are domiciled, without regard to conflict of law provisions.
For Users in the European Union: If you are a consumer domiciled in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are domiciled. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
Dispute Resolution: Any disputes arising out of or relating to these Terms or the Extension shall be subject to the exclusive jurisdiction of the courts of the European Union Member State in which you are domiciled, or, if you are not domiciled in a Member State, the courts of a Member State of your choice.
Alternative Dispute Resolution: If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to resolve disputes.
13. Severability and Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ingesto regarding the Extension and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Ingesto.
15. Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms or any rights hereunder without your consent.
